Terms of Service

These Terms of Service (“Terms”) govern the use of the platform CaribbeanScout.com (“Platform”), operated by Network4U Sarl, located at 97150 St. Martin, French West Indies (“we,” “us,” “our”). By accessing or using the Platform, you agree to be bound by these Terms.
1. Scope of Services
CaribbeanScout.com acts solely as an intermediary platform connecting users (“Customers”) with independent service providers (“Providers”) offering:
- Tours & Excursions
- Car Rentals
- Hotels & Accommodation
- Restaurants & Shops
- Cosmetic & Wellness Services
We do not own, manage, or control the services offered by Providers. All contracts for services are entered directly between Customers and Providers.
2. Registration & User Accounts
- To use the Platform, both Customers and Providers must create an account with accurate and complete information.
- Users are responsible for maintaining the confidentiality of their login credentials.
- We reserve the right to suspend or terminate accounts for misuse, fraud, or violation of these Terms.
3. Payments & Fees
- Payments are processed securely via Stripe and PayPal, our third-party payment providers.
- Providers may choose one of the following subscription models:
- Explorer Package: 5% commission per booking
- Anchor Package: Annual fee of €149
- Captain Package: Annual fee of €200 plus 5% commission per booking
- Providers may set their own service fees. Customers are responsible for reviewing these before booking.
- All payments are subject to the terms and conditions of Stripe and PayPal.
4. Liability & Disclaimers
- We act only as an intermediary and are not liable for:
- Delays, cancellations, or unavailability of services
- Weather conditions, natural events, or traffic disruptions
- Service quality, safety, or compliance of Providers
- Any claims, refunds, or complaints must be addressed directly between the Customer and the Provider.
5. Cancellation & Refunds
- Each Provider sets their own cancellation and refund policy.
- Customers must review and agree to these terms before booking.
- CaribbeanScout.com is not responsible for enforcing Provider-specific refund policies.
6. Content & Intellectual Property
- All content on the Platform, including text, images, logos, and branding, is owned by or licensed to Network4U Sarl.
- Users may not copy, modify, or distribute any content without prior written consent.
7. Governing Law & Jurisdiction
These Terms are governed by the laws of Guadeloupe, French West Indies. Any disputes arising from the use of the Platform shall be subject to the exclusive jurisdiction of the competent courts in Guadeloupe.
8. Modifications
We reserve the right to update or modify these Terms at any time. Continued use of the Platform constitutes acceptance of the revised Terms.
